Terms and conditions of delivery and trade

These terms and conditions apply to consumer purchases on www.clas.as, owned and operated by Clas ApS. By shopping on the webshop, you accept the terms and conditions below. The rules are formulated in accordance with Danish law, including the Consumer Contracts Act and the Danish Purchase Act.

Prices and payment

All prices are in DKK and include VAT. Any promotional discounts are clearly stated before you approve the order.


Payment methods: We accept regular payment cards (e.g. Visa/Dankort and Mastercard) and MobilePay. We do not charge a card fee for payments with consumer cards.


Prepayment & withdrawal of amount: When paying by card, the amount is reserved when ordering and is only withdrawn when the order has been shipped. When paying by bank transfer/instant payment (e.g. MobilePay), the amount can be withdrawn immediately.


Security: Payment is made via an encrypted connection. You may be asked for strong customer authentication (3-D Secure).


Placing an order and concluding an agreement

Once you have placed an order, you will receive an order confirmation by e-mail. The agreement is only final when you have received the order confirmation.


We reserve the right to make any errors (e.g. obvious price errors), out-of-stock items and force majeure. This does not affect your statutory rights under Danish law.


Delivery

Free delivery: We offer free standard delivery on all orders to Denmark. Any additional options for faster/different delivery methods may cost extra and are clearly stated at checkout.


Delivery area: Delivery takes place in Denmark (excluding the Faroe Islands and Greenland), unless otherwise stated.


Delivery time: The expected delivery time is stated at checkout and on the order confirmation. We will inform you as soon as possible in case of delays.


Transfer of risk: The risk of the goods only passes to you when you physically receive them. However, if you expressly choose a carrier other than the one we offer, the risk passes when the goods are handed over to that carrier.


Unclaimed packages: Not collecting a package is not in itself a cancellation. Always give us clear notice if you wish to cancel. If a package is returned as unclaimed, we may deduct our documented return costs from any refund, if you have also notified us of your cancellation.


Right of withdrawal (distance selling)

You have 14 days to cancel from the day you receive the goods.


How to cancel: Give us a clear and unambiguous notice (e.g. by email) before the deadline. You can use our standard cancellation form at the bottom of the terms, but this is not a requirement.


Returns: Once you have notified your cancellation, you have 14 days to return the item. You pay the return shipping yourself, unless otherwise agreed. You bear the risk of the item during return shipping – therefore please use traceable shipping.


Condition and Deterioration of Value: You must handle the item to determine its nature, characteristics and how it functions. Deterioration of value resulting from other use may be deducted from your refund.


Refund: We will refund the purchase amount no later than 14 days after we have received your notice of cancellation. However, we may withhold the refund until we have received the returned item or you have provided documentation for the return.


Delivery costs: If you have paid for delivery, we will refund the cost of the cheapest standard delivery. Any additional costs for express delivery are not refunded. For free standard delivery, there is no refund for delivery.


Exceptions to cancellation: There is no right of cancellation for, among other things, specially manufactured goods if the seal is broken, which you have expressly consented to have delivered before the expiry of the cancellation period. (See the full list in the Danish Consumer Contracts Act).

Complaint (defects in the product)

You have a 2-year right of complaint under the Danish Sales Act. If a defect becomes apparent within 12 months of delivery, it is presumed to have been present at the time of delivery, unless otherwise stated (the presumption rule).


In the event of a justified complaint, you may, depending on the circumstances, demand remediation (repair), replacement, a proportional discount or cancellation of the purchase if the defect is significant.


Complain within a reasonable time after you discovered the defect. If you complain within 2 months, it is always considered timely.

 

When returning a product for a claim, we cover reasonable shipping costs. Always contact us before returning a product for a claim so that we can provide a return label or arrange a process.


Warranty

Any warranties from the manufacturer give you additional rights in addition to the Danish Sales Act. A warranty never limits your statutory rights under the Danish Sales Act.


Limitation of liability

We are not liable for indirect losses such as operating losses, lost profits or consequential damages, unless otherwise provided for by mandatory legislation. Product liability follows the mandatory rules of Danish law.


Personal information

Processing of personal data is carried out in accordance with the GDPR and the Data Protection Act. See our privacy policy at www.clas.as, where purposes, legal bases, storage periods, recipients, etc. are described, as well as your rights (insight, deletion, etc.).

Changes to terms

We may update the Terms from time to time. The version that applies to your order is the version published at the time of ordering and is stated in the order confirmation.


Applicable law and venue

Purchases made with Clas ApS are subject to Danish law. Any disputes can be brought before the Danish courts at your place of residence or the Maritime and Commercial Court in Copenhagen according to applicable rules.
