Terms and Conditions

These Terms and Conditions apply to consumer purchases on www.clas.as, owned and operated by Clas ApS. By purchasing from our webshop, you accept the terms set out below. This English version is provided for convenience only. In case of any discrepancy, the original Danish version shall prevail.

2. Scope of Application

These Terms are governed by Danish law. If you reside in another EU/EEA country or in the United Kingdom, you may also rely on the mandatory consumer protection rights granted to you under the laws of your country of residence, which shall take precedence over these Terms where they provide a higher level of protection.


3. Prices and Payment

  • All prices are stated in Danish kroner (DKK) and include VAT.
  • Accepted payment methods: Visa/Dankort, Mastercard, and MobilePay. No surcharge for consumer card payments.
  • For card payments, the amount is reserved when you place your order and charged only when goods are dispatched.
  • For instant payments (e.g. MobilePay), the amount may be charged immediately.
  • Payments are processed via encrypted connection and may require Strong Customer Authentication (3-D Secure).


4. Order Placement and Conclusion of Contract

Once you have placed an order, you will receive an order confirmation by e-mail. The purchase agreement is concluded only when you receive the order confirmation.


We reserve the right to correct obvious errors (e.g. manifest price errors), stock shortages, and force majeure events. This does not affect your statutory consumer rights.


5. Delivery

  • Free standard delivery on all orders within Denmark. Additional costs may apply for express or alternative delivery methods, shown at checkout.
  • Delivery area: Denmark (excluding the Faroe Islands and Greenland). For EU/EEA and UK customers, delivery is available where stated at checkout. Charges and times vary by destination.
  • Estimated delivery times are displayed at checkout and in the order confirmation. Delays will be communicated promptly.
  • Passing of risk: The risk of goods passes to you only once you physically receive them. If you explicitly choose a different carrier than offered, risk passes when goods are handed to that carrier.
  • Uncollected parcels do not in themselves constitute withdrawal. If a parcel is returned as uncollected, documented return costs may be deducted from your refund, provided you have also notified withdrawal.


6. Right of Withdrawal (Distance Selling)

  • You have a 14-day right of withdrawal starting on the day you physically receive the goods.
  • You must give clear and unequivocal notice (e.g. by e-mail) before the withdrawal period expires. You may use the standard withdrawal form provided, but it is not mandatory.
  • Goods must be returned within 14 days of notice. You pay return shipping unless otherwise agreed. You bear the risk of goods during return; tracked shipping is recommended.
  • You may handle goods to establish their nature, characteristics, and functioning. Depreciation from further use may be deducted from your refund.
  • Refunds are made within 14 days of notice of withdrawal, but may be withheld until goods are received back or you provide proof of return.
  • If you paid delivery costs, only the cheapest standard delivery is refunded. Express or premium delivery charges are non-refundable. Where standard delivery was free, no refund applies.
  • Exceptions: No right of withdrawal for made-to-order goods, unsealed goods not suitable for return for health or hygiene reasons, perishable goods, or digital content supplied with your prior express consent before expiry of the withdrawal period.

7. Defects and Warranty Claims (Statutory Rights)

  • You have a 2-year statutory right to complain under the Danish Sale of Goods Act.
  • If a defect appears within 12 months of delivery, it is presumed to have existed at delivery unless proven otherwise.
  • Remedies: repair, replacement, proportional price reduction, or rescission if the defect is significant.
  • You must complain within a reasonable time after discovering a defect. Within 2 months is always considered timely.
  • For justified complaints, reasonable return shipping costs are covered. Contact us before returning goods.


8. Manufacturer’s Guarantees

Any manufacturer’s guarantee provides additional rights beyond your statutory rights. Such guarantees do not limit your statutory rights.


9. Limitation of Liability

We are not liable for indirect losses, including loss of business, profits, or consequential damages, unless otherwise required by mandatory law. Product liability follows mandatory Danish law.


10. Personal Data

Personal data is processed in accordance with the GDPR and the Danish Data Protection Act. See our Privacy Policy at www.clas.as for purposes, legal bases, storage periods, recipients, and your rights.


11. Complaints and Dispute Resolution

If conditions are met, the complaint may be referred to the Consumer Complaints Board via Nævnenes Hus.
For cross-border disputes, European Consumer Centre Denmark (ECC Denmark) can provide advice. For UK residents, alternative dispute resolution bodies accredited under UK law may also be relevant.

12. Changes to Terms

We may update these Terms from time to time. The version applicable to your order is the one published at the time of ordering and confirmed in your order confirmation.


13. Governing Law and Jurisdiction

Contracts with Clas ApS are governed by Danish law. Disputes may be brought before the Danish courts of your domicile or the Maritime and Commercial High Court in Copenhagen, in accordance with applicable rules.


If you reside in another EU/EEA country or the United Kingdom, you may also invoke the mandatory consumer protection rights of your country of residence, which prevail where they provide higher protection.


14. Language

This English version is provided solely as a convenience translation. In the event of any discrepancy, the Danish version shall prevail.
